EzriCare Eye Drops Lawsuit

July 6, 2023 | Attorney, Matthew Dolman

The Centers for Disease Control (CDC) has issued an alert for all consumers of EzriCare Artificial Tears (eye drops manufactured by Global Pharma). Users should immediately discontinue the use of this product. The CDC issued this urgent warning after discovering that EzriCare Artificial Tears are the likely cause of a cluster of antibiotic-resistant infections known as Carbapenem-Resistant Pseudomonas Aeruginosa bacteria or CRPAA.

Multiple EzriCare Artificial Tears users have developed severe infections and suffered permanent impairments, including vision loss, in addition to extensive financial and emotional losses. The CDC has also warned healthcare practitioners and consumers to discontinue the use of Delsam Pharma Artificial Tears due to the proliferation of bacterial infections. Additionally, the FDA warns consumers against purchasing or using Ezricare Artificial Tears as a result of potential bacterial contamination from pseudomonas aeruginosa bacteria.

The product liability attorneys of Dolman Law Group anticipate numerous product liability claims will be filed against Global Pharma, the manufacturer of EzriCare, along with Desalt Pharma's Artificial Tears. We are prepared to assist plaintiffs in seeking maximum compensation for their damages via a lawsuit against Ezricare and Delsam.

Do You Have a Potential Personal Injury Claim From Using EzriCare Eye Drops?

If you exhibit any symptoms of an eye infection, you should immediately seek medical attention and follow up with your customary healthcare provider as soon as possible. Keep in mind that Global Pharma issued a voluntary nationwide recall of their artificial tears product due to concerns of contaminated eye drops leading to adverse events.

Further, Global Pharma advises all individuals with signs of a pseudomonas aeruginosa infection to seek medical attention immediately.

You can reach out to our team to schedule a free consultation with one of our product liability lawyers to discuss the details of your case and learn more about what damages may qualify for compensation in an EzriCare lawsuit or Delsam Pharma artificial tears lawsuit due to contamination of both products via dangerous bacteria.

How Can a Lawyer Help With Your EzriCare Eye Drop Lawsuit?

When a defective medical product causes injury and financial, mental, or physical losses, the injured party may be entitled to receive compensation in a personal injury lawsuit. Working with an experienced defective medication lawyer is crucial if you intend to pursue a product liability claim against a negligent manufacturer.

Skilled injury attorneys can analyze complex medical records, construct detailed timelines, and negotiate strategically to ensure that your settlement accurately reflects the extent of your damages. Additionally, a dedicated product liability law firm will have the resources to get the product tested, secure expert witnesses, and keep up with the administrative demands of your case.

Securing a reputable product liability lawyer to negotiate your claim communicates two key things to the insurance company. First, it shows you’re willing to invest time and effort into pursuing your claim rather than hoping to take whatever compensation they offer.

Second, hiring a personal injury lawyer indicates that your claim likely has merit, as product liability attorneys work on a contingency fee basis and don’t recover their fees until they successfully settle a claim. It is in their best interest to take on cases where the defendant will likely be held responsible for their client’s damages.

EzriCare Eye Drops Recalled After Multi-State Cluster of Infections Reported

EzriCare Artificial Tears is an over-the-counter treatment for dry eyes. These multi-use, preservative-free eye drops are commonly used by people who suffer from allergies, engage in heavy computer use, or take other medications that result in dry eyes. It contains 1% Carboxymethylcellulose Sodium, which imitates the tear film of the eye to keep it hydrated.

On January 20th, 2023, the CDC issued a statement warning that EzriCare Artificial Tears may be causing serious types of problems, including eye infections and bloodstream infections. Thus far, infections have been reported in 11 states across the country in 50 different patients.

The common denominator between patients was the use of EzriCare Artificial Tears. While the CDC continues to conduct lab tests to confirm that the EzriCare Artificial Tears cause infections, eye drop users should stop using this product immediately and monitor themselves for signs of infection.

Global Pharma Healthcare has issued a recall on artificial tears eye drops that were distributed by EzriCare and Delsam Pharma after reports of bacterial contamination emerged on February 2, 2023. The contaminated eye drops have resulted in a multi-state cluster of infections caused by Verona Integron-mediated Metallo-β-lactamase (VIM)- and Guiana-Extended Spectrum-β-Lactamase (GES)-producing carbapenem-resistant Pseudomonas aeruginosa (VIM-GES-CRPA). As a result, there have been reports of eye infections, permanent loss of vision, and one death associated with the use of these eye drops.

EzriCare Eye Drop Infections Are Resisting Antibiotics

EzriCare Artificial Tears appear to be responsible for cases of Verona Integron‐mediated Metallo‐β‐lactamase (VIM)‐ and Guiana‐Extended Spectrum‐β‐Lactamase (GES) producing carbapenem‐resistant Pseudomonas aeruginosa (VIM‐GES‐CRPA). VIM and GES are enzymes that are notorious for effectively deactivating antibiotics like penicillin.

When traditional antibiotics are ineffective, doctors usually turn to carbapenems, a class of drugs that are typically used to treat severe, gram-positive bacterial infections. In this case, the VIM and GES are creating Pseudomonas aeruginosa, a gram-negative bacteria.

Gram-negative bacteria have an outer membrane that is difficult for antibiotics to penetrate. That means that not only is the Pseudomonas aeruginosa resistant to antibiotics like penicillin, but it is also carbapenem-resistant.

Pseudomonas aeruginosa is often found in hospitals and can manifest as many different types of infections. In addition to the patients who have become infected by using EzriCare Artificial Tears, there is a concern that these antibiotic-resistant infections may spread. The serious bacterial infections caused by EzriCare eye drops can lead to a number of health issues, including:

  • Sepsis
  • Blindness
  • Brain damage
  • Tissue damage
  • Organ failure

What Damages Can I Recover in an EzriCare Eye Drop Lawsuit?

EzriCare Eye Drop Lawsuit

Due to the severity of the infections associated with the use of defective EzriCare Artificial Tears, plaintiffs may be eligible to recover substantial compensation for their damages. Legal damages offer plaintiffs financial relief for their losses, both economic and non-economic in nature. Plaintiffs may seek compensation for monetary losses in the form of economic damages. They can also potentially recover non-economic damages that reimburse them for emotional losses.

Examples of Damages in an EzriCare Artificial Tears Lawsuit:

The amount of compensation you receive for your damages will depend on the degree to which your losses have impacted your life. For example, a patient who is permanently blinded from an eye infection caused by defective EzriCare eye drops will likely receive substantial compensation. As a result, they will no longer be able to drive, see the faces of their loved ones, and may be forced to change careers and sacrifice favorite hobbies. This can lead to mental health issues like anxiety and depression.

In comparison, someone who developed an infection that did not require hospitalization would likely receive a smaller payment. The best way to maximize your compensation is by hiring a product liability attorney who can review the evidence of your damages, calculate their value, and then advocate for that amount to be compensated in an EzriCare Artificial Tears lawsuit.

What to Do If You Have Been Using Ezricac Articifical Tears

Do not throw the defective Erzicare Artificial Tears out. Collect any documentation you have related to your purchase or prescription of EzriCare Artificial Tears, as well as any medical records you have demonstrating you sought treatment for your infection.

If you have not already seen a medical provider, you should contact one as soon as possible if you notice signs of infection. Receiving medical care should be your priority, as it can give you better treatment options if you have developed an infection.

Additionally, it is an important preventative measure in terms of protecting your legal options. One tactic defendants use to undermine the validity of an injured party’s claim is to argue that they were negligent in treating their injuries. If someone doesn't seek medical treatment, the defendant should not be responsible for the full amount of damages the injured party incurred. This can be avoided by seeking prompt medical care.

After securing medical care, you should seek out the services of a qualified personal injury lawyer who specializes in product liability claims. They will be able to compile evidence of your injury and resulting damages to make a convincing case for compensation in a product liability lawsuit.

If you attempt to negotiate your own product liability lawsuit, you will very likely recover far less compensation than you would have received with the help of a personal injury lawyer.
