IVC Filter Lawsuits Piling Up Against Cook Medical
Medical device industry giant, Cook Medical is braced for a continued rising tide of IVC filter lawsuits related to certain models of their inferior vena cava filters.
An IVC filter is a cone shaped metal device that is inserted into the inferior vena cava just below the kidneys. It is designed to trap an embolism, a blood clot that originates in one of the deep veins in the legs, breaks loose, and heads for the heart and lungs.
The potential is great for the embolism to cause a blockage in the pulmonary artery. Known as a pulmonary embolism, the blockage in one or both arteries can lead to difficulty breathing, chest pain and death by cutting off deoxygenated blood from the heart to the lungs. Once the clot is captured by an IVC filter, blood can flow around the clot and the blood's natural anti-coagulants will break the blood clot down.
IVC filter lawsuits filed against Cook Medical allege that their Gunther Tulip and Celect models are connected to serious issues which include migration of the device, fracture and perforation may result in embolism, organ damage and death. The first lawsuits were filed over four years ago, but recently, the number of complaints was reported as 560 with 100 of them being filed last summer.
Other IVC Filter Lawsuits
IVC filters by various manufacturers have been implanted in approximately 200,000 patients annually by physicians to prevent pulmonary embolism. Other manufacturers are facing similar IVC filter lawsuits including Cordis, a subsidiary of pharmaceutical behemoth Johnson & Johnson and C.R Bard another major player in the medical industry. C.R. Bard manufactures the Recovery Filter which is being blamed in lawsuits for 27 deaths and hundreds of injuries.
Marsha Lovejoy, manager of global content strategy for Cook Medical defended the device in an interview with the Indianapolis Business Journal. “Cook's IVC filters are not defective in design or manufacturing. We will continue to defend against those claims.”
The IVC cases against Cook Medical have been consolidated in U.S. District Court in Indianapolis and are scheduled to proceed to trial in March 2017.
