Major Verdicts of Monsanto Weedkiller Cancer Lawsuits

Two Major Lawsuit Verdicts and Monsanto’s Glyphosate Weedkiller

The major agrochemical and agricultural company Monsanto has become the target of thousands of lawsuits all claiming that their weedkiller known as Roundup contributed to the development of cancer. Of all these lawsuits, there have been two where plaintiffs have managed to successfully recover compensation for the damages they suffered because of Monsanto’s Roundup weedkiller. It is because of these two key lawsuit verdicts that many anticipate Monsanto and their new owner Bayer are due for a storm of similar lawsuits from others that have had long-term exposure to Roundup weedkiller and have developed cancer.

Major Lawsuits Set Precedent Regarding Roundup Weedkiller and Cancer

The two major lawsuit verdicts regarding Monsanto’s Roundup weedkiller and its potential health risks have so far set a precedent that has opened the floodgates for additional lawsuits where plaintiffs have developed cancer under similar circumstances of exposure to the weedkiller.

Dewayne Johnson vs. Monsanto Lawsuit

In 2016 Dewayne Johnson filed a lawsuit against Monsanto claiming that their Roundup weedkiller he used in his work helped cause his cancer. The groundskeeper began working for the public school district of Benicia near San Francisco in 2012. Over the next few years, part of his job was using the weedkiller Roundup as an herbicide and sprayed it at several schools and sports fields in the district. While spraying the weedkiller, Dewayne Johnson took some precautions to keep from being exposed to the weedkiller but occasional leaks would sometimes drench his skin.

After several years Mr. Johnson noticed that he was starting to experience skin irritation and the breakout of rashes upon his body. As time went on, his face suffered marks and lesions appeared all over his body. Upon examination by a doctor, he was diagnosed with cancer. More specifically, terminal non-Hodgkin’s lymphoma. This type of cancer attacks the blood and immune system creating lesions and extremely debilitating pain.

Upon hearing about how an ingredient in Roundup weedkiller called glyphosate was linked to an increase in cancer risk by several studies, Dewayne Johnson looked into his legal options and filed a lawsuit against Monsanto based on the connection between glyphosate exposure and cancer risk confirmed by numerous studies.

Monsanto Loses Roundup Lawsuit to Dewayne Johnson

The Dewayne vs. Monsanto lawsuit would be the first of lawsuits where a plaintiff claimed that their cancer was in part caused by long-term exposure to Roundup weedkiller. As such the verdict would influence any other product liability lawsuits with similar claims and thankfully for those plaintiffs claiming Roundup influenced their cancer development, Dewayne was successful.

After Dewayne’s side presented several studies indicating the connection between glyphosate and cancer risk and expert testimony on the effects of glyphosate exposure, a California jury unanimously found in 2018 that Monsanto’s glyphosate-containing products presented a “substantial danger” to consumers. Monsanto’s sale of this potentially dangerous product to consumers with no warning at all on the product demonstrated severe negligence on their part especially since they should have been aware of the danger to consumers in the first place. Monsanto maintained that their product was completely safe and that the studies presented were cherry-picked to present conclusions that benefited Dewayne Johnson’s case. However, the jury disagreed. Dewayne Johnson ended up being awarded $250m in punitive damages and $39.2m for losses. After an appeal by Monsanto, the amount was reduced to $78.5 million.

Edwin Hardeman vs. Monsanto Lawsuit

Dewayne Johnson’s lawsuit opened the door for legal action against Monsanto for their carcinogenic weedkiller but it seems that the recent lawsuit against them filed by Edwin Hardeman may be what ensures that it remains open. Edwin Hardeman filed a lawsuit against Monsanto after being diagnosed with non-Hodgkin’s lymphoma and realizing it was likely connected to his long-term use of Roundup weedkiller on his large property for almost three decades. The case ended up following a fairly similar path where Edwin Hardeman’s case was made by presenting a number of studies and expert opinions on how the roundup ingredient glyphosate is connected to an increased risk of suffering lymphatic cancer. Once again a jury found that Monsanto was negligent of putting out a product with health hazards and no warning despite having ample knowledge of a possible risk. As a result, Edwin Hardeman ended up winning the case and Monsanto was ordered to pay $80 million in damages to Mr. Hardeman.

Future Monsanto Weedkiller Lawsuits

A U.S. district judge named Vince Chhabria is asking Monsanto to start mediation with the lawyers of cancer victims currently suing Monsanto over their Roundup weedkiller’s contribution to their non-Hodgkin’s lymphoma. There are roughly 11,000 different plaintiffs with lawsuits against Monsanto. Judge Chhabria is overseeing over 800 of these lawsuits with several thousand more pending in state courts all over the United States.  It has been estimated that the total cost of a global settlement of these lawsuits could run between $3 billion and $5 billion. This comes as a massive blow to Bayer who recently bought Monsanto in a $66 billion deal and now must shoulder the burden of Monsanto’s negligence.

Glyphosate Product Caused Cancer Lawsuits

International Agency for Research on Cancer (IARC) published the results of a year-long investigation into the link between several different insecticides and herbicides, including glyphosate and cancer in 2015. They came to the conclusion that glyphosate is “probably carcinogenic to humans.”. Researchers from the University of Washington went on to analyze the number of studies done on glyphosate and it’s effect’s when exposed to humans. They came to the conclusion that long-term glyphosate exposure can increase the risk of developing non-Hodgkin’s lymphoma by 41% after doing a meta-analysis on all studies done on the subject from 2001 to 2018.  

Those that work in agricultural or landscaping occupations are at a high risk to be exposed to glyphosate and develop non-Hodkin’s lymphoma. Not just Roundup but a variety of herbicide products contain this harmful ingredient.
