As a driver, it’s the number one rule embedded in our head as a moral obligation-never leave the scene of an accident, no matter what. Being involved in a serious automobile accident, especially if injury results, creates an overwhelming feeling of wanting to run away from the situation for many. As an Florida injury attorney, I can assure you this is not the right choice to make from both a legal and moral standpoint.
This past Thursday Dr. Kevin Wynne, a respected resident and Chiropractor in Lake Mary, was arrested after police believe he hit a motorcyclist in Volusia County and then fled from the scene.
Florida Highway Patrol officers said Dr. Wynne crashed into Harley-Davidson rider Sabra Vocaturo, 50, with his white Infinity sport utility vehicle back in February on State Road 415. She was in town visiting for the Daytona 500 race. The impact resulted in Vocaturo being ejected from her motorcycle and into the oncoming traffic lane, where she was hit by two other cars and killed at the scene. The drivers of the two cars stopped to help Vocaturo, but sadly there was nothing they could do.
After the accident Dr. Wynne proceeded to drive to a parking lot in Deltona and then called a friend to pick him up. The following day Dr. Wynne’s lawyer, Lisabeth Fryer, called authorities and informed them on where they could find the abandoned vehicle. Officials confirmed that the damage to the SUV was consistent with the scene of the accident.
After reviewing Dr. Wynne’s cellphone records, it was proven that he was in fact in the area at the time of the crash. Investigators also found a receipt in his SUV which confirmed he had paid a bill about an hour and a half before the time of the accident at the New Smyrna Beach bar and grill.
After a thorough investigation, Dr. Wynne was arrested on Thursday at his home by the Florida Highway Patrol. He is being charged with fleeing the scene of an accident involving death and reckless driving for operating too fast under the rainy conditions. Currently Dr. Wynne is being held in the Seminole County Jail with a bail set at $50,000.
Under Florida Law, if Dr. Wynne had not left the scene of the accident he would have only been ticketed for reckless driving. Instead, he is now facing a felony charge which can carry a maximum sentence of 30 years in prison.
Wynne is the owner of Wynne Family Chiropractic located in Lake Mary, and his website states that he gives special treatment for accident victims, claiming that he actually became a chiropractor after being injured in a car crash. His webpage is no longer accessible, stating that it is being updated and will be back up again soon.
