Description: Our 42 year old client was diagnosed with a Chiari malformation found on a cervical MRI. Chiari malformations have long been believed to be congenital. In fact, we were able to demonstrate through the utilization of two expert witnesses that an asymptomatic Chiari malformation can become symptomatic as a result of trauma. The insurance company’s highest offer prior to us filing suit was $7,200. They came to this low sum by claiming that this was a minor soft tissue injury that pre-existed the car accident.
