Bill Opposing Florida Insurance Carrier Bad Faith Was Shot Down

Just this week, the House Civil Justice Subcommittee was reviewing a proposal that would have essentially ended the bad faith protections in the law.  Currently, bad faith is the only tool a Trial Lawyer has to make sure Insurance Companies are held accountable for its inaction.  With this protection removed, Insurance Companies would essentially make minimal offers on all injury claims and do a complete disservice to those injured in an automobile accident, motorcycle accident, slip and fall, and those suffering from Traumatic Brain Injuries (TBI) due to accidents.

For another year, bad faith in regards to automobile accidents and motorcycle accidents will exist in Florida Law.  It should go without saying that this is a huge victory for everyday people against big global insurance companies with unlimited resources.  Currently, there are six weeks left in this session and other areas are under attack by Big Business and Insurance Companies.  The current target is the PIP bill that would limit attorney fees, a bill that protects emergency room doctors, and another that essentially forces all individuals injured in an accident to seek an evaluation at an emergency room or an urgent care facility right away otherwise a claim would be denied.  One of the major PIP bills seeks an overhaul of the no-fault system here in Florida.
